An imperative element is being unnoticed in the health-care debate among the Democratic presidential candidates: Namely, whether the health insurance plans they suggest are constitutional.
The largest disparity between their health-insurance plans is that Sen. Hillary Rodham Clinton would "mandate" that everybody (with limited exceptions) buy private health insurance. Although Sen. Barack Obama's plans as well have a mandate, it is much narrower it is merely needed for children. Obama primarily relies on funding economies of scale and rule to willingly achieve his version of universal coverage. Are health insurance consents constitutional? They surely are unparalleled. The federal government doesn't normally require Americans to buy particular goods or services from personal parties.
