HIPAA- HEALTH INSURANCE PORTABILITY AND ACCOUNTABILITY ACT
The HIPAA is an act which was introduced to protect
personnel health care information of individuals. The portable here means
that even if people switch jobs, they do not face any problems in getting
proper coverage. And accountability adheres to how secure the person’s
health
care information is maintained by the medical centers.
w According to the HIPAA,
the US department of justice can sue your health care provider, if you
think he has not abided to the act or if he has leaked out some of your
private medical information. Provided you have the necessary evidence.
w If a medical center or
their related organizations electronically transfer their patient’s private
medical information, they have to act according to the HIPAA.
w The health insurance
accountability and portability act is mainly schemed to protect the members
in the health care plan.
w If you are not under
any group health plan, then theHIPAA also allows you to take up an
individual health policy.
w The HIPAA provides protection
for both individual health insurance policy as well as group health insurance
policy.
w New rights which help
individuals to adopt a new plan when they encounter any change like marriage
or loose jobs etc.
w Under the HIPAA there
should not be any discrimination between the employees. The payment of
premium amounts and the benefits enjoyed must be equal.
w Special enrollment opportunity
is available under the HIPAA. If an employee or his dependent loses health
coverage then he is eligible to obtain the special enrollment opportunity.
w The group health plans
and insurance companies do not possess any rights for asking some individuals
to pay more than usual, just because of any medical reasons.
w If an individual switches
jobs, then he has to move from one plan to another. In that case the benefits
of the plans might change and the coverage provided by the two plans might
be different. This situation is not restricted by the HIPAA.
w This is possible under
the HIPAA- Suppose that the individual is enjoying health coverage offered
by his employer. And if that employer moves, there will not be any problem
if the current employer does not offer health coverage. Because the individual
would still be able to obtain coverage using his previous employers plan.
w The HIPAA also applies
to self insured
group health plans.
